How to object to a zoning plan on public display
New or amended zoning plans are put on public display (askı, literally "hung up") before they come into force. This period gives owners and other interested parties the chance to see the plan and to object to it.
The display period
Under the Zoning Law (İmar Kanunu), approved plans are announced at the municipality (belediye) and in the e-Plan system for 30 days. Objections to the plan can be made during this period. The municipal council examines the objections and decides on them within 15 days.
How to object
- Apply in writing (by petition) to the administration that approved the plan (the municipality, or the relevant ministry / governor's office); state clearly the block / parcel, the plan decision you are objecting to and your reasons.
- You can attach documents such as the title deed record, a sketch, photographs or an expert report.
- Keep the registration record showing that your petition was submitted within the display period.
Going to court
If the objection is rejected or the plan becomes final, an action for annulment can be brought in the administrative courts; the time limit for bringing it is generally 60 days, counted from the end of the display period or from the reply to the objection. As time limits can be complicated, get help from a lawyer.
