Partner terms

These terms apply to the relationship between the estate agencies, estate agents in the Turkish Republic of Northern Cyprus (North Cyprus) and valuation firms to which land requests made on parselx.com.tr ("ParselX") are passed (the "Partner") and ParselX, the operator of ParselX. Offices that open an office account and use the lead marketplace are also bound by the Office account and lead marketplace terms (in Turkish).

1. The role of ParselX

• ParselX does not publish listings, does not act as an intermediary in property sales, takes no commission on sales and is not a party to the discussions or contracts between the person making the request and the Partner.
• A request is passed to the Partner only if the person has given explicit consent. The Partner is itself the data controller for the personal data it receives.

2. Certificates and authority

• Türkiye: a valid Real Estate Trade Authorisation Certificate. North Cyprus: registration in the Estate Agents Register under the Estate Agents Registration and Operations Law and membership of the Turkish Cypriot Estate Agents Association (KTEB). Valuation: a Capital Markets Board (SPK) licence.
• The Partner informs ParselX immediately if its certificate is suspended, cancelled or expires; requests are then no longer passed on.
• The person applying declares that the information given is correct and that they are authorised to represent the business.

3. Use of requests

• The Partner contacts the person only about that request; it tries to reach them within 2 working days at the latest and tells ParselX the outcome (contacted, completed, did not work out).
• It does not use the personal data in the request to promote other products or services, does not give it to third parties, does not publish it as a listing and does not add it to bulk messaging lists. In Türkiye, it obtains separate consent from the person before sending commercial electronic messages and complies with the Message Management System (İYS) rules.
• When the request is completed, or it becomes clear that it will not be, the data are deleted, apart from legal retention obligations; in any case within 12 months of the request being passed on.
• If the person withdraws consent or asks ParselX to delete their data, ParselX informs the Partner, and the Partner deletes the data without delay.

4. Data security

• Only the staff handling the request have access to it; computers, phones and accounts are protected by a password or screen lock; request details are not shared on social media or in group chats.
• If a security incident is noticed (e.g. a lost phone, unauthorised access to an account), the Partner informs ParselX immediately, within 24 hours at the latest.

5. Partners in North Cyprus

• Under Turkish data protection law (KVKK), North Cyprus counts as a foreign country. Requests are passed on only after the parties have signed the standard contract published by the Personal Data Protection Board (controller to controller) and it has been notified to the Personal Data Protection Authority. If this contract and these terms conflict, the standard contract prevails.
• The Partner complies with the law of North Cyprus and advises foreign buyers to get legal advice from an independent lawyer and to have the type of title deed (koçan) checked.

6. Fees

If a fee is to be charged for passing on requests, the amount and conditions are agreed separately in writing between the parties. ParselX takes no commission on property sales.

7. Suspension and termination

ParselX may stop passing on requests and end the partnership if these terms are breached, if people who made requests complain, if the certificate is not valid or if misuse is suspected. The Partner may end the partnership at any time in writing. Sections 3 and 4 continue to apply to requests passed on before the end.

8. Personal data of applicants (privacy notice)

As data controller, ParselX processes the company, contact person, contact, certificate, area and language details you give on the partnership application form in order to assess your application, verify your certificate, contact you and manage the partnership, on the legal grounds in Article 5(2)(c) (directly related to the conclusion or performance of a contract) and Article 5(2)(f) (legitimate interest) of Law No. 6698.

• Your details are not shared with third parties, except for checks with the competent authorities to verify your certificate (the Ministry of Trade's Real Estate Trade Information System; in North Cyprus the Estate Agents Registration Commission and the Turkish Cypriot Estate Agents Association; the SPK). Applications are kept, like the rest of the site's data, on our servers in a data centre in the European Union and sent by e-mail through our service provider (the conditions for transfers abroad are explained in the KVKK privacy notice).
• If your application is rejected or the partnership ends, your details are deleted after 1 year; you can ask for earlier deletion at any time.
• To exercise your rights under Article 11 of the Law (information, correction, deletion, objection etc.), write to [email protected].

9. Changes

ParselX may update these terms; the current version is published on this page and partners are informed by e-mail.
