Farm storage building
Criteria in the regulation
In short: If the family's own land in the district exceeds the threshold (2 ha on absolute, special crop or marginal land, 1 ha on perennial (planted) land, 0.3 ha under greenhouse cultivation), a storage building equal to 1% of the total land can be built.
Conditions
- Only for the producer's own crops.
- Leased land and land used for contract farming do not count; on a jointly owned parcel, your share counts.
- The technical project report states what will be stored and lists the land; the provincial directorate assesses the request if it sees a need.
- Producer organisations can build storage in proportion to their member farmers' land; a member who gets permission this way cannot apply separately.
Permit route
- Outside a large plain protection area: the provincial directorate of agriculture and forestry reviews the application and the governor's office grants permission; the land class does not matter, no alternative site is required and the Soil Conservation Board is not involved.
- In a large plain protection area: the Ministry grants permission provided there is no alternative site and the Board gives a favourable opinion; an alternative site is looked for first on your land outside the protection area and in specialised agricultural organised industrial zones (OIZs) in the district.
Zoning rules
- In areas without a zoning plan: FAR 0.4 for all buildings on the parcel, height 7.5 m and 2 storeys; setbacks of 10 m from the road and 5 m from the parcel boundary (Zoning Regulation for Unplanned Areas, art. 63).
- It is assumed that this structure will be treated as one of the farm structures listed in that article.
- If the parcel is covered by an approved environmental plan or zoning plan, the plan's provisions apply first.
Interpretation note
The regulation does not say whether the storage area means footprint or floor area, or how the threshold applies to land of mixed classes.
