Rooftop solar on a farm structure
Criteria in the regulation
In short: Solar panels to power a farm structure go on the roof first; only on marginal land, and only if the roof is not enough, can up to 1.5% of the facility area be used on the ground.
Conditions
- The panel area may not exceed the facility's agricultural electricity needs; an electrical engineer's report is required.
- Notarised undertaking: if production is abandoned for 6 months or longer, the permit is cancelled; the electricity generated counts as a free contribution to YEKDEM (the renewable energy support mechanism).
- Solar panels cannot be installed on greenhouse roofs.
Permit route
- Outside a large plain protection area: the provincial directorate of agriculture and forestry reviews the application and the governor's office grants permission; the land class does not matter, no alternative site is required and the Soil Conservation Board is not involved.
- In a large plain protection area: the Ministry grants permission provided there is no alternative site and the Board gives a favourable opinion; an alternative site is looked for first on your land outside the protection area and in specialised agricultural organised industrial zones (OIZs) in the district.
Zoning rules
- The zoning rules of the main building apply; there is no separate setback distance.
- If the parcel is covered by an approved environmental plan or zoning plan, the plan's provisions apply first.
Interpretation note
The base for the ground-mounted share is called the "facility area" in Annex 1 but the "project area" in Annex 15.
Solar plants built to sell electricity (non-agricultural) come under separate rules and are only allowed on dry marginal land.
